Legality of dogs

does anyone know what the deal is with dogs? If you're inside and get bitten can you sue under the duty of care? They could argue you were trespassing an knee there were dogs. I could argue back that knowing dogs would bite me is not conducive to caring... I should know this... being a trainee lawyer. But I don't. I suck at this...

As far as I'm aware there has to be signs stating that Guard dogs are in use on the premises. If a trespasser ignores the signs and gets bitten it's pretty much their own fault and the building owner isn't liable. However if there aren't any signs that's a totally different matter.

I think cases like that are looked at on a case by case basis though and it would really be down to the details of the circumstance surrounding the "biting" that occured.

You could try asking "hypotheticals" at the firm you're training at if you specialise in that type of law though. I'm constantly asking hypothetical questions at my firm much to the amusement of my colleagues.

I'm only doing it at uni at the moment. But I have put a few hypotheticals out to the class hahah

Haha I'm not a lawyer, I can think of nothing worse! But I do work in a law firm and you definitely pick up quite a bit of knowledge just being surrounded by it all day every day.

It depends on the circumstances of getting bitten. If the dog is off the lead or roaming it's against the law and you have a case against the handler and security company.

The dogs are generally trained in handler protection and only in that circumstance can they bite. They are not allowed to be released on an intruder, and they are not allowed to chase you.

None of us are legal experts, I don't think we should be speculating on something we don't 100% know anything about, people keep saying trespass is civil and "it's ok, they can't do anything"

Well that's 100% bollocks and mess with the wrong people and it's a dream come true, I can vouch for that!

Yes. There's all sorts of stuff at play here. You've got response to civil acts (trespass) with criminal acts (setting dogs on someone) damages may be awarded if a duty of care is owed but may be taken away under contributory negligence. It's a bit of a tricky one
